Welcome to epochloop (the “App,” “we,” or “Service”). Please read these Terms of Use carefully before using the App. By using the App, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the epochloop iOS application and website (https://www.epochloop.com/), you agree to comply with these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Service Description

epochloop is an artificial intelligence-based conversation application that uses third-party AI services (including DeepSeek and Qwen) to provide users with intelligent conversation and content generation services.

3. User Eligibility

3.1 Age Requirement

You must be at least 12 years old to use this Service. Age verification is handled through Apple’s platform age restriction mechanism.

3.2 Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security and confidentiality of your account
  • You are responsible for all activities that occur under your account
  • If you discover any unauthorized use of your account, please notify us immediately

4. Subscription and Payment

4.1 Subscription Services

The App offers paid subscription services, including:

  • Weekly subscription
  • Monthly subscription

4.2 Payment

  • All payments are processed through Apple In-App Purchase
  • Subscription fees will be charged to your Apple account upon confirmation of purchase
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period

4.3 Refund Policy

Refund requests are subject to Apple’s refund policy. Please request refunds through Apple’s support channels. We cannot directly process refund requests.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will take effect in your next subscription period and you will be notified in advance.

5. Usage Rules

5.1 Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

5.2 Prohibited Conduct

You may not:

  • Illegal Content: Post, transmit, or request generation of any illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
  • Violence and Hate: Post or request generation of content containing violence, hate speech, or discriminatory content
  • Sexual Content: Post or request generation of pornographic or sexually suggestive content
  • Commercial Abuse: Use the Service for unauthorized commercial purposes or large-scale automated requests
  • System Attacks: Attempt to hack, reverse engineer, interfere with, or compromise the security features of the App
  • Rights Infringement: Infringe upon the intellectual property, privacy, or other rights of others
  • Misinformation: Deliberately spread false or misleading information
  • Spam: Send spam or engage in other forms of abusive behavior

5.3 Content Moderation

We use automated moderation systems to monitor and filter inappropriate content. Accounts that violate usage rules may be suspended or terminated.

6. Intellectual Property

6.1 Service Ownership

The App and all its content, features, and functionality (including but not limited to software, text, graphics, logos) are owned by epochloop or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

  • You retain ownership of the content you create
  • Conversations and content you generate belong to you
  • We will not use your content for any purpose other than providing the Service

6.3 License Restrictions

You may not:

  • Copy, modify, distribute, or sell any part of the App
  • Reverse engineer the App or attempt to extract source code
  • Remove or modify any copyright or proprietary notices

7. AI-Generated Content Disclaimer

7.1 Accuracy

AI-generated content is provided for reference only and is not guaranteed to be accurate, complete, or reliable. We are not responsible for the accuracy of AI-generated content.

7.2 Professional Advice

The Service does not provide professional advice. You should not use AI-generated content for:

  • Medical diagnosis or treatment decisions
  • Legal advice or legal decisions
  • Financial or investment advice
  • Any other decisions requiring professional qualifications

7.3 User Responsibility

You are solely responsible for how you use AI-generated content. Please consult qualified professionals before making important decisions.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Service Changes and Termination

9.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9.2 Account Termination

We reserve the right to suspend or terminate your account for the following reasons:

  • Violation of these Terms of Use
  • Engaging in fraudulent or illegal activities
  • Abusing the Service or harming other users
  • Extended inactivity

9.3 Effects of Termination

After account termination:

  • You will lose access to the Service
  • Your data will be deleted in accordance with our Privacy Policy
  • Unused subscription fees will not be refunded

10. Disclaimers

The Service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Service Availability

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We are not responsible for service interruptions, delays, or errors.

10.3 Third-Party Services

The Service relies on third-party AI providers. We are not responsible for the performance, availability, or content of these third-party services.

11. Limitation of Liability

To the maximum extent permitted by law, epochloop and its developers shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Any damages arising from the use or inability to use the Service
  • Any damages resulting from decisions made based on AI-generated content

The above limitations apply even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless epochloop and its developers from any claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorney’s fees) arising from:

  • Your use of the Service
  • Your violation of these Terms of Use
  • Your infringement of any third-party rights

13. Dispute Resolution

13.1 Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms of Use or the Service shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

13.3 Dispute Resolution Method

Any disputes should first be resolved through amicable negotiation. If negotiation fails, disputes will be resolved through court litigation in the courts of the Hong Kong Special Administrative Region.

14. Changes to Terms

We reserve the right to modify these Terms of Use at any time. When we make significant changes, we will notify you through the App. Your continued use of the Service after notification constitutes acceptance of the modified terms.

15. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and epochloop regarding the use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals.
